Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Mire & Muse LLC, a Michigan limited liability company ("Company," "we," "us," or "our"), governing your access to and use of Two Swan, including any related mobile applications and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Description of Service

Two Swan is a wedding planning application that helps couples organize their wedding by managing guest lists, budgets, vendors, timelines, invitations, and other wedding-related information. The Service is provided on a subscription basis with various tiers offering different features.

Account Registration

To use Two Swan, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 18 years old to create an account and use the Service.

Subscription and Payment

Subscription Plans

Two Swan offers various subscription tiers (Petal, Bloom, and Luxe) with different features and pricing. Details of each plan are available on our pricing page.

Free Trial

New subscribers receive a 3-day free trial. No charge will be made during the trial period. After the trial expires your selected subscription plan will automatically begin and your payment method will be charged. You may cancel before the trial ends to avoid any charges.

Billing

Subscriptions are billed in advance on a monthly or annual basis depending on your selected plan. By subscribing, you authorize us to charge your payment method automatically for each billing period.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.

Price Changes

We reserve the right to modify subscription prices. Any price changes will be communicated to you in advance and will apply to the next billing period following the notice.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on intellectual property rights
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service
• Use the Service to harass, abuse, or harm others
• Resell or redistribute the Service without authorization
• Use automated means to access the Service without permission

Intellectual Property

The Service and its original content, features, and functionality are owned by Mire & Muse LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written consent.

You retain ownership of any content you submit to the Service (such as guest lists, notes, and planning information). By submitting content, you grant us a limited license to use, store, and display that content solely to provide the Service to you.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIRE & MUSE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Mire & Muse LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought exclusively in the state or federal courts located in Michigan.

Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Michigan.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mire & Muse LLC regarding the Service and supersede all prior agreements and understandings.
